Agreement to Terms

Welcome to GoTwende. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

Definitions

• "You" or "your" refers to the user of the Platform
• "Service Providers" refers to activity operators, accommodations, and tour providers
• "Bookings" refers to reservations made through the Platform

Use of the Platform

Eligibility

You must be at least 18 years old to use the Platform and make bookings. By using the Platform, you represent and warrant that you meet this requirement.

Account Registration

You may need to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Updating your information as needed

Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Provide false or misleading information
• Interfere with the Platform's operation
• Attempt to gain unauthorized access to the Platform
• Use the Platform for fraudulent purposes

Bookings and Payments

Booking Process

When you make a booking through the Platform, you are entering into a contract with the Service Provider. GoTwende acts as an intermediary to facilitate the booking but is not a party to the contract between you and the Service Provider.

Pricing and Payment

• All prices are displayed in the selected currency
• Prices may be subject to change until booking is confirmed
• Payment is processed securely through our payment partners
• You are responsible for all charges incurred under your account

Cancellations and Refunds

Cancellation policies vary by Service Provider and activity. Please review the specific cancellation policy before making a booking. For more information, see our Cancellation Policy.

Service Provider Responsibilities

Service Providers are solely responsible for:

• The quality and delivery of their services
• Complying with all applicable laws and regulations
• Maintaining necessary licenses, permits, and insurance
• Safety standards and equipment
• Honoring their cancellation and refund policies

Limitation of Liability

To the maximum extent permitted by law:

• GoTwende is not liable for the acts or omissions of Service Providers
• We do not guarantee the accuracy of information provided by Service Providers
• We are not responsible for injuries, losses, or damages incurred during activities
• Our total liability shall not exceed the amount you paid for the booking

Intellectual Property

The Platform and its content, including text, graphics, logos, and software, are owned by GoTwende or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the laws of Namibia. You agree to waive your right to participate in class actions.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

Termination

We may suspend or terminate your access to the Platform at any time, with or without cause or notice, for any violation of these Terms or for any other reason we deem appropriate.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Namibia, without regard to its conflict of law provisions.
